Terms of Service

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. Notify us immediately at support@propefi.com of any unauthorized use.

Propefi lets homeowners and professionals capture, organize, verify and transfer property records. Records may be processed with AI and OCR and secured with cryptographic proofs on a private, permissioned ledger. Features, plans and availability may change over time.

Paid plans are billed in advance on a monthly or annual basis and renew automatically at the then-current price until cancelled. We disclose the price, billing frequency, renewal terms and cancellation method before you subscribe, and send renewal reminders where required.

Cancellation. You may cancel at any time from your account settings in the same manner you subscribed — online, in as few steps as it took to sign up — or by emailing support@propefi.com. Cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. These provisions are intended to comply with California's automatic renewal law (Cal. Bus. & Prof. Code § 17600 et seq.) and the FTC's negative-option rules.

Taxes are your responsibility. Failed payments may result in suspension of paid features.

You retain ownership of the receipts, documents, photos and other content you upload (“Your Content”). You grant Propefi a worldwide, non-exclusive licence to host, process, reproduce, adapt and display Your Content solely to operate, secure and improve the Services and to deliver the features you request, including generating property records and reports and transferring a record to a new owner when you authorize it. We may use aggregated or de-identified data that does not identify you or your property for analytics and product development.

You represent that you have the rights to upload Your Content and that it is accurate to the best of your knowledge.

Where you authorize a transfer at closing, the property record is assigned to the new owner and your personal account information is not transferred with it. Once transferred, you may lose access to the record. Blockchain entries are immutable by design; we can restrict access to and delete off-chain content, but cryptographic proofs already written cannot be erased.

You agree not to:

• Upload false, fraudulent or misleading records;
• Infringe intellectual property or privacy rights;
• Scrape, reverse engineer, or resell the Services or their data without permission;
• Interfere with security, access other users' accounts, or introduce malware;
• Use the Services for unlawful discrimination or in violation of fair housing law.

Realtors, contractors and other professionals are independent third parties and are not employees or agents of Propefi. We do not guarantee the quality, licensing, pricing or outcome of any service arranged through Propefix, and any contract for work is between you and the provider.

Condition scores, maintenance forecasts, valuation signals and extracted data are generated in part by automated systems and may contain errors or omissions. They are informational only and are not appraisals, inspections, engineering opinions, insurance underwriting, tax or legal advice. Verify important information independently before relying on it.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPEFI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPEFI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR PROPERTY VALUE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$100. Nothing limits liability that cannot be limited by law, including for fraud or gross negligence.

You agree to indemnify and hold Propefi harmless from claims arising out of Your Content, your use of the Services, or your violation of these Terms or applicable law.

You may close your account at any time. We may suspend or terminate access for breach of these Terms, suspected fraud, or legal requirement, with notice where practicable. You may export your records before closure; after closure we delete or de-identify data in line with our Privacy Policy.

Most concerns can be resolved by contacting support@propefi.com. If we cannot resolve a dispute informally within 30 days, you and Propefi agree to binding individual arbitration administered by JAMS under its Streamlined Rules, seated in Los Angeles County, California, rather than in court, except that either party may bring a claim in small claims court or seek injunctive relief for intellectual property misuse.

Class action waiver. Disputes will be resolved on an individual basis; no class or representative proceedings. This waiver does not apply to claims that cannot be waived under California law, including public injunctive relief.

30-day opt-out. You may opt out of arbitration by emailing legal@propefi.com within 30 days of first accepting these Terms.

Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at 1-800-952-5210.

Accessibility: we aim to conform to WCAG 2.2 AA. Report accessibility issues to support@propefi.com and we will work to resolve them.

Information on this website about Propefi's financing, market size or projections is for informational purposes only. These Terms are governed by the laws of the State of California, without regard to conflict of law rules. If any provision is unenforceable, the rest remains in effect.
